If two Booths, up to 8 Main & 8 Lessor items permitted. · Some vendors choose NOT to sell beverages because ALL soda, water and ice must be purchased from Festival, including that for personal/staff use or for food temperatures. · Charitable Groups may exclusively sell beverages if pre-approved. · For-profit Vendors shall NOT sell any soda or water. Other approved Beverage items (some teas, coffees, juice boxes, milks, misc., etc.) shall be listed as a Lessor item. FESTIVAL DATES (HELD RAIN OR SHINE) 2011: Friday June 24 (5:00-11:00PM) & Saturday June 25 (Noon-11:00PM) CONFIRMATIONS · Vendors receive notification of acceptance including complete Rules of Conduct no later than 6/17. If Contract is not accepted, fees are returned within 30 days and act as notification of such. · All Fees must be Pre-paid. · Nonrefundable once accepted. · $30 fee for insufficient funds. · Complete Staging Instructions (includes instructions on times, parking, tear-down requirements, etc.) sent via email no later than June 18. If no email, SASE must be included with Contract. · Contracts can be refused for any reason. STAGING RULES · Vendors must incur all labor duties during staging. Festival staff/volunteers are not permitted to assist Vendors. · Vehicles permitted on grounds up to 1 hour during the following times (only): If arriving Thursday of Festival weekend, anytime from 6:00PM until 8:00PM (only) If arriving Friday of Festival weekend, anytime from 9:00AM until 2:00PM (at latest). To replenish items on Saturday, anytime until 11:00AM (at latest). For the safety of Powell Festival’s 20,000+ visitors, staff and vendors, staging directions must be respected. Initial here to show acceptance._______ The undersigned Exhibitor agrees that this is not a lease but only permits the temporary use of space provided for the duration of the “Powell Festival” and acknowledges that its activities in conjunction with the event are done at own risk. The undersigned, who is authorized to execute this agreement on behalf of Exhibitor, warrants that they shall hold harmless and indemnify Historic Downtown Powell, Inc. (HDPI), Powell Festival Club, City of Powell, their members, sponsors, volunteers, agents, officers, directors and employees from any and all claims from any cause, for injury, damage, loss, theft, actions, claims and liabilities to persons or property arising out of its activities. All of the above regulations must be observed or HDPI reserves the right to have offenders of any regulations immediately removed without refund.
